Terms of Service

These Terms of Service (“Terms”) are an agreement between you and [Company Legal Name] (“Lorelei,” “we,” “us”) and govern your use of the Lorelei app, the Whisper feature, and our website (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Eligibility and accounts

You must be at least 18 years old, and of legal age to form a binding contract where you live, to use Lorelei. You sign in with Apple, and you're responsible for activity on your account and for keeping your device secure. Please give us accurate information and keep it up to date. You may not create an account for someone else or transfer your account.

2. The Service

Lorelei offers interactive fiction: original stories that respond to your choices, plus Whisper, which lets you hold private conversations with characters inside a story. Stories, features, allowances, and prices may change over time, and we may add, modify, or retire stories and features. We'll try to give reasonable notice of changes that significantly affect you.

3. AI-generated stories

Lorelei's stories and character responses are generated by artificial intelligence. Please keep in mind:

It's fiction. Characters in Lorelei, including those you talk to in Whisper, are fictional. They are not real people and do not have real feelings, knowledge, or intentions.
It isn't advice. Nothing in a story or conversation is medical, mental health, legal, financial, or other professional advice. If you are in crisis or in danger, contact local emergency services or a crisis line.
It can be imperfect. Generated content may occasionally be inaccurate, inconsistent, repetitive, or unexpected. We work to prevent this, and you can report anything that seems wrong or inappropriate from within the app.
Similar outputs. Because of how AI works, other readers may receive story content similar to yours.

4. Your content

“Your Content” means the choices, custom actions, typed or spoken instructions, Whisper messages, and personalization details you provide. You keep any rights you have in Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and adapt Your Content as needed to operate, provide, secure, and improve the Service, including sending it to our service providers as described in our Privacy Policy. This license ends when you delete Your Content or your account, except where we must keep it for legal reasons.

You are responsible for Your Content, and you confirm that you have the rights needed to provide it.

5. Acceptable use

You agree not to:

Create, request, or attempt to generate any sexual or romantic content involving minors or characters depicted as minors. We have zero tolerance for this and will terminate accounts and report to authorities where required.
Use Lorelei to harass, threaten, impersonate, or create sexual content about real people.
Use the Service for anything illegal, or to generate content that promotes violence, hate, or self-harm in the real world.
Try to bypass our content settings, safety systems, usage allowances, or gem and purchase systems, including through prompt manipulation or by trying to extract our instructions, story plans, or hidden story information.
Copy, scrape, reverse engineer, or access the Service by automated means, or use any part of it, including generated stories, to train or build a competing product or AI model.
Resell, sublicense, or commercially exploit the Service or its content.
Interfere with or disrupt the Service or other readers' use of it.

6. Content settings

You can choose your preferred romantic intensity and other content settings. All stories, at every setting, remain within our content policies and the rules of the platforms we distribute on, including the Apple App Store. We may limit, adjust, or decline to generate content to comply with the law, platform rules, or our policies.

7. Our content and your license

The Service, including our story worlds, characters, story bibles, artwork, illustrations, design, software, and trademarks, belongs to Lorelei or our licensors and is protected by intellectual property laws. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service and read stories generated for you for your own non-commercial entertainment.

You're welcome to share short excerpts and screenshots of your stories and Whisper conversations on social media for personal, non-commercial purposes. Please don't republish whole chapters or stories, present them as your own original work for sale, or use our characters or worlds commercially.

9. Lorelei Premium

Lorelei Premium is an optional auto-renewing subscription offered with weekly, monthly, and annual billing periods. Prices and what each plan includes are shown in the app before you buy.

Payment is charged to your Apple ID account when you confirm the purchase.
Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription in your Apple ID account settings. Cancelling stops future renewals; you keep Premium until the end of the period you've paid for.
If we offer a free trial, any unused portion is forfeited when you purchase a subscription.
Refunds are handled by Apple under its policies. We can't issue refunds for purchases made through the App Store.
Premium includes generous but not unlimited allowances, for example for Whisper conversations and story direction. Current allowances are described in the app.
If prices change, Apple will notify you as required, and you can cancel before the new price applies.

10. Gems

Gems are a virtual item you can buy or earn (for example through daily rewards, finishing chapters, story milestones, referrals, or a Premium allocation) and use to unlock optional content and features in Lorelei.

Gems give you a limited license to access content in the Service. They have no cash value, are not your property, cannot be exchanged for money, and cannot be transferred, sold, or traded.
Purchased gems do not expire. Gems you earn or receive for free may come with an expiry date, which we'll show when they're granted.
All gem purchases are final except as required by law or Apple's refund policies.
We may change the gem cost of features going forward, but we won't take away content you've already unlocked with gems while the Service remains available.
We may correct gem balances that result from errors, fraud, or violations of these Terms.
If we ever discontinue the Service, we'll give reasonable notice and handle unused purchased gems as required by applicable law and platform rules.

11. Suspension and termination

You can stop using Lorelei and delete your account at any time from within the app. Deleting your account doesn't cancel an App Store subscription, so please cancel that in your Apple ID settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if needed to protect the Service or other readers. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and disputes) will survive.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that generated content will be accurate or meet your expectations. Some places don't allow these disclaimers, so some may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Lorelei will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold Lorelei harmless from claims, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

15. Apple App Store terms

If you download Lorelei from the Apple App Store, you also agree to the following:

These Terms are between you and Lorelei only, not Apple. Lorelei, not Apple, is solely responsible for the app and its content.
Your license to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Lorelei, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
If a third party claims that the app or your use of it infringes their intellectual property rights, Lorelei, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the app.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Governing law and disputes

These Terms are governed by the laws of [State/Country], without regard to its conflict-of-laws rules. Before filing a claim, please contact us at [support@yourdomain.com] so we can try to resolve it informally. Any dispute that isn't resolved informally will be brought exclusively in the courts located in [County, State/Country], unless the law where you live gives you the right to bring it in your local courts. 17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms.
